As of 30 March 2023, Legislative Decree No. 24 of 10 March 2023 has been in force, transposing the Whistleblowing framework introduced by Directive (EU) No. 1937/2019 on the “Protection of persons who report breaches of Union law.” This regulatory framework establishes rules and procedures designed to ensure effective protection for “whistleblowers,” i.e., employees who report information obtained in a professional context regarding violations, including both unlawful acts or omissions and abusive practices in the workplace. Legislative Decree No. 24 of 10 March 2023 - whose provisions take effect from 15 July 2023 - imposes an obligation to establish and make available to employees and others an internal, confidential, and protected channel for receiving reports.
Furthermore, the applicable legislation requires a high level of organization and awareness with regard to confidentiality, the protection of employees who report violations, and the operational procedures for doing so. Accordingly, it becomes a priority to define an internal channel for receiving and managing reports, to identify technical and organizational measures with a level of security appropriate to the specific risks arising from the processing carried out, to promote a Data Protection Impact Assessment (DPIA), and to regulate relationships with any external providers (e.g., providers of reporting channels) pursuant to Article 28 of Regulation (EU) 2016/679.
